Relevant officials from the Supreme People's Court filing Court, Civil Court One and Civil Court II clearly stated in an interview with reporters on the 9th that we must resolutely prevent cases that should be accepted according to law on the grounds of compulsory application of the model text, and fully guarantee that the parties should exercise their right to sue in accordance with the law.

"The people's courts strictly implement the requirements of the filing registration system, and file all cases and handle all lawsuits. For cases that fail to file, one must be found and investigated and dealt with." said a relevant person in charge of the Supreme Court's filing court.

According to reports, in March 2024, the Supreme Court, the Ministry of Justice, and the All-China Lawyers Association jointly issued a notice to formulate a table-based, factor-based civil complaint and defense demonstration text for 11 common and frequent civil cases such as financial loans, private lending, and labor disputes.

A relevant person in charge of the Second Civil Court of the Supreme People's Court introduced that the model text factors the content of prosecution and defense, refined the prompts and guidance, and simplified the filling work, which will help solve problems such as the simpler style of civil litigation documents, insufficient guidance for the parties to prosecute and defense, and it is difficult to meet the needs of different types of dispute resolution, and improve the quality and efficiency of trial work.

It is reported that the Supreme Court recently issued a notice requiring the people's courts to fully promote and apply the model text. Courts at all levels provide electronic versions of sample complaints and defense examples through various online and offline channels such as litigation service halls and online service platforms of the people's courts. Many courts have posted sample text QR codes and produced fill-in guidelines combining pictures and texts to provide the public with download or scan code to fill in.

"The release of a model text of the complaint and defense letter is to facilitate the public's litigation." A relevant person in charge of the Supreme Court's filing court stated that if the people's court fully respects the choice of the parties and the parties and their attorneys fill out the model text of the complaint and defense letter, it will not affect the simultaneous submission of the complaint and defense letter formed in accordance with their own expression habits.

"For some cases that the parties cannot fill out, we have increased our guidance and guidance, and provide litigation consultation and complaint writing services to special groups such as the elderly. At the same time, we insist on digital empowerment. Some courts are exploring to embed the example text elements of complaints and defense letters into the online litigation service platform. As long as the parties upload the complaint, they can automatically identify the elements and automatically backfilling them according to the model text style." The person in charge said.

A relevant person in charge of the First Civil Court of the Supreme People's Court stated that the People's Court will continue to optimize the content of the demonstration text based on the improvement suggestions put forward by the parties and their attorneys in the process of using the demonstration text, accelerate the construction of intelligent auxiliary filling functions, provide intelligent identification, backfill and other services, and gradually expand the use of the demonstration text of the complaint and defense letter. At the same time, supervision will be strengthened for problems such as deviation and "changing flavor" in the promotion and application process, and seriously correct them, and continuously promote judicial measures to facilitate and benefit the people in depth and practice.
